HOLOGRAM ZOO LEHIGH VALLEY
WAIVER AND RELEASE OF LIABILITY
By signing below, I acknowledge and agree to the following terms as a condition of participating in a group visit to Hologram Zoo Lehigh Valley, operated by 28Fortune, LLC (“Company”).
Assumption of Risk: I understand that my visit to Company may involve walking through exhibit areas and interacting with three-dimensional (3D) holographic technology. I acknowledge that these activities carry inherent risks, including the possibility of tripping or falling, minor injuries (such as sprains or strains), and discomfort (such as dizziness or disorientation) from being in a 3D environment. I voluntarily assume all such risks of participating in the Company group visit.
Health and Safety: I affirm that I am physically fit to participate and not aware of any health condition that would put me at an unusual risk in a 3D environment. I will follow all safety instructions and facility rules provided by Company staff, and I will use all equipment (including 3D glasses and other interactive devices) responsibly. I agree to notify Company staff immediately if I feel any unsafe condition or require assistance during the visit.
Release of Liability: I hereby release, waive, and discharge Company and its owners, employees, agents, and volunteers from any and all liability, claims, or demands that I or my representatives may have arising out of or relating to my participation in the group visit. This release includes, but is not limited to, liability for any personal injury, illness, death, or property damage that I may experience. This release applies even if the injury or loss is caused in whole or in part by the negligence of Company or its staff, except in cases of gross negligence or intentional misconduct.
Indemnification: I agree to hold harmless and indemnify Company from any claim, demand, lawsuit, or expense (including reasonable attorneys’ fees) arising out of my own actions during the visit or my failure to comply with the any provided rules. If I, or anyone on my behalf, file a claim against Company, I will be responsible for all loss, damages, and expenses incurred by Company, including legal fees.
Personal Responsibility for Conduct: I understand that I am responsible for my own conduct during the visit. I agree to behave appropriately and comply with all Company policies. I will not engage in any behavior that risks injury to myself, other visitors, or Company property. I also agree that I will be responsible for any damage I may cause to Company’s facilities or equipment due to my negligence or intentional acts, and I will reimburse Company for the cost of repairs or replacements.
Acknowledgment of Understanding: I have carefully read this waiver and fully understand its contents. I am aware that by signing this document, I am waiving certain legal rights, including the right to sue Company for injuries or losses I might sustain. I sign this document freely and voluntarily, understanding that it is a binding legal agreement.
